Commercial Pest Control Service Agreement

1. Rentokil Initial Pty Ltd ABN 98 000 034 597, acting as Rentokil Pest Control (“RPC”), undertakes to provide a pesticide inspection and treatment programme (the “Service Plan” or “Plan”) in the areas indicated for the costs (plus GST) with respect to the pests described herein, in accordance with these Terms and Conditions of Sale. The customer`s furniture and appliances are excluded, unless they are mentioned in this document for inspection and / or treatment. Additional pests or areas shall be investigated and proposed separately. 4. Term: This Agreement applies to a minimum initial term of twelve (12) months beginning from the date of this Agreement, unless otherwise agreed. This Agreement is automatically renewed if it is not terminated or amended and applies until terminated in writing by either Party with a period of at least two (2) calendar months. A termination may not take effect before the last day of the initial minimum term, except in accordance with clause 22. The customer acknowledges that any non-communication entails the responsibility of the customer for the amounts corresponding to the fees for a period of two (2) months. CANCELLATION OF A CONFIRMED MAINTENANCE SERVICE: Life Happens! We will have it, and from time to time, you will miss an appointment because there is something that has appeared. You can cancel your service outside of a 24-hour period without penalty. If you cancel your appointment within 24 hours of confirmed service, a fee of $25.00 USD will be charged. If the property is not readily made available for service after confirmation of the date, a fee of $25.00 will be charged.

Why should we levy this tax? Setting schedules for customers is a major challenge. Once your appointment is scheduled, agreed and confirmed by you, cancelling your service within 24 hours will not give us enough time to schedule another client and will eventually lose the revenue that would have been generated. Paying technicians for this hour when no work is generated, the company costs time and money. Be attentive and call us in time if you need to cancel your appointment. Thank you for your understanding. 28. General: (a) This Agreement may only be amended in writing, which has been signed by both parties. b) any reference to “written” or “in writing” includes e-mail. (c) Where any provision of this Agreement is unlawful, invalid or unenforceable, it may be severed without prejudice to the enforceability of the remaining provisions. (d) Customer may not assign its rights under this Agreement without the prior consent of RPC.

(e) Any exemption provided for in this Agreement is a permanent commitment right that is separate and independent from the other obligations of the party giving the compensation and that continues to terminate or terminate this Agreement. (f) This Agreement shall be governed by the laws of the state or territory where the Services are provided to the Customer and the parties submit to the jurisdiction of the courts of that state or territory. WARRANTY: COVERED PEST CONTROL: Depending on the type of service chosen, New Era Pest Control guarantees pest control in and around your home by providing a regular pest control service. Some pests require more than one treatment, while others may need a single control service. Ask your seller for more details. Our guarantee for you is that if you see UnFall during the warranty period, we will get back to you for free and proceed with the correction. Observing an insect in the structure does not mean that your home is infected. 19. Subcontractors: RPC may appoint or employ any person, subcontractor or agent for the provision of services under this Agreement and is responsible for the performance by such subcontractor of RPC`s obligations under this Agreement. . .
